PARTICIPANT AGREEMENT & DATA CONTRIBUTION CONTRACT
1. PARTIES
This Participant Agreement (“Agreement”) is entered into between:
Joy 4 Healthy Living™️ Powered by WatsonGuard™️
(“Provider”)
and
The individual completing and electronically signing this Agreement
(“Participant”)
Effective Date: The date this Agreement is electronically accepted and submitted by the Participant.
WatsonGuard™ serves as the wellness monitoring, educational, and participant-support system utilized by Joy 4 Healthy Living™. WatsonGuard™ does not replace physicians or other licensed healthcare professionals and does not independently establish a physician-patient relationship.

2. PURPOSE OF AGREEMENT
The purpose of this Agreement is to establish the Participant’s participation in a structured wellness monitoring, education, and health-information support program utilizing the WatsonGuard™ system.
WatsonGuard™ is designed to help Participants remain informed, engaged, and better prepared between healthcare encounters by organizing participant-provided information, identifying trends and patterns, supporting wellness education, and helping Participants communicate meaningful information with their healthcare professionals.
Participation is voluntary. Participants are encouraged to provide health and wellness information consistently so that WatsonGuard™ has sufficient current information to provide meaningful monitoring, trend analysis, personalized wellness insights, and participant support.
The quality and continuity of WatsonGuard™ monitoring depend upon the availability, accuracy, and consistency of information provided by the Participant. When sufficient current information is unavailable, monitoring or personalized support may become limited, temporarily inactive, or unavailable until adequate information is again provided.
Reduced or interrupted participation is not, by itself, treated as punishment or misconduct. Rather, it may affect WatsonGuard™’s ability to responsibly provide individualized monitoring, analysis, and support.
Participant-provided information may also contribute, where permitted under this Agreement and applicable requirements, to the continued evaluation, development, improvement, and validation of WatsonGuard™ methodologies.

3. PROGRAM OVERVIEW
The Participant may engage in a structured wellness monitoring and educational support program utilizing WatsonGuard™. Depending upon the Participant’s needs, available information, and level of participation, monitoring and support may include, but are not limited to:
– Blood pressure and pulse/heart-rate tracking
– Hydration monitoring
– Nutrition and sodium intake tracking
– Medication and supplement information provided by the Participant
– Physical activity and exercise tracking
– Symptom and wellness reporting
– Lifestyle and behavioral information relevant to wellness goals
– Health trend and pattern analysis
– Educational wellness guidance and participant support
– Information organization to help Participants prepare for and communicate during healthcare encounters
Participants are encouraged to provide information with sufficient consistency to allow WatsonGuard™ to identify meaningful trends and changes over time. The type and frequency of information requested may vary according to the Participant’s circumstances, program activities, and monitoring needs.
Participant-provided information may contribute to WatsonGuard™ monitoring methodologies, including applicable safety and trend-analysis models.
WatsonGuard™ does not diagnose disease, prescribe treatment, or replace physicians or other licensed healthcare professionals. Its role is to educate, organize participant-provided information, identify relevant trends and patterns, support informed decision-making, and strengthen the connection between Participants and their healthcare professionals.

4. PARTICIPANT RESPONSIBILITIES
To support meaningful and responsible use of WatsonGuard™, the Participant agrees to:
1. Provide accurate and truthful information.
Information submitted to WatsonGuard™ should be accurate to the best of the Participant’s knowledge.
2. Participate with reasonable consistency.
Participants are encouraged to provide requested health and wellness information consistently enough to support meaningful monitoring, trend analysis, and personalized wellness support.
3. Follow applicable program instructions and safety guidance.
Participants should follow instructions related to the proper use of WatsonGuard™ and applicable Joy 4 Healthy Living™ program activities.
4. Communicate significant changes when appropriate.
Participants are encouraged to report relevant changes in symptoms, medications, healthcare encounters, wellness activities, or other information that may materially affect interpretation of their wellness information.
5. Respond to reasonable follow-up requests when possible.
WatsonGuard™ or authorized program personnel may request clarification or additional information when needed to better understand participant-provided information or maintain continuity of monitoring.
6. Understand the relationship between participation and monitoring.
WatsonGuard™ can only analyze information that is available to the system. If a Participant stops providing sufficient current information, personalized monitoring, trend analysis, alerts, reports, or other individualized support may become limited or temporarily inactive.
An interruption in participation does not automatically constitute misconduct or breach of this Agreement. However, intentionally providing false or materially misleading information, misuse of the program, or other serious violations of program requirements may result in restriction or termination of participation.
Participants who wish to resume active monitoring after a period of inactivity may be asked to provide updated information so that WatsonGuard™ can responsibly reestablish a current monitoring baseline.

5. DATA USAGE & INTELLECTUAL PROPERTY
The Participant understands that information voluntarily provided through the Joy 4 Healthy Living™ program and WatsonGuard™ may be collected, organized, analyzed, and used to provide wellness monitoring, trend analysis, educational support, participant reports, program evaluation, and other services described in this Agreement.
Participant information may also contribute, where permitted, to the evaluation, validation, improvement, and continued development of WatsonGuard™ systems, methodologies, algorithms, analytical models, workflows, educational tools, and related intellectual property.
When participant information is used for system development, evaluation, research, statistical analysis, demonstrations, publications, intellectual-property development, or similar secondary purposes, reasonable measures will be taken to use de-identified, anonymized, aggregated, or otherwise appropriately protected information, as applicable to the purpose and circumstances.
The Participant retains ownership of their personal information. Participation in the program does not transfer ownership of the Participant’s personal health or wellness information to Joy 4 Healthy Living™ or WatsonGuard™.
WatsonGuard™ and its owners or authorized developers retain all rights, title, and interest in the WatsonGuard™ platform and its independently developed systems, methodologies, algorithms, analytical models, workflows, reports, templates, educational materials, software, processes, inventions, trademarks, copyrights, patents, patent applications, and other intellectual property.
Participation does not provide the Participant with ownership rights in WatsonGuard™ intellectual property merely because participant-provided information may contribute to system evaluation, validation, improvement, or development.
Participant information will not be sold as personally identifiable information to third parties for advertising or unrelated commercial marketing purposes.
Nothing in this section authorizes WatsonGuard™ or Joy 4 Healthy Living™ to publicly identify a Participant in research, promotional materials, publications, demonstrations, or other external uses without separate authorization when such authorization is required.

6. PROGRAM STRUCTURE & PARTICIPATION BENEFITS
Joy 4 Healthy Living™ Powered by WatsonGuard™ may provide certain community wellness activities, educational resources, monitoring services, and participant-support services on a complimentary or reduced-cost basis.
Complimentary participation is intended to support community wellness, education, engagement, and access to defined WatsonGuard™ monitoring and support services.
Complimentary participation is not compensation for the Participant’s personal information and does not constitute payment for health or wellness data.
The availability and level of individualized WatsonGuard™ monitoring and personalized support depend upon the Participant’s active participation and the availability of sufficient current information. When sufficient current information is unavailable, individualized monitoring or data-dependent support may be paused or limited until participation is reactivated.
A Participant whose individualized monitoring has been paused may remain eligible for certain community, educational, or general wellness resources, subject to applicable program guidelines.
Enhanced or Premium Services
Joy 4 Healthy Living™ and/or WatsonGuard™ may separately offer enhanced, premium, or higher-touch services beyond those included in the complimentary program. Such services may include additional individualized support, expanded reporting, enhanced trend analysis, healthcare-visit preparation or review, or other services made available by the program.
Enrollment in any paid service is voluntary and separate from complimentary participation. A Participant will not automatically become enrolled in, charged for, or financially obligated to any paid service solely because participation becomes inactive or WatsonGuard™ monitoring is paused.
Any paid service requires separate disclosure of applicable services and fees and the Participant’s affirmative authorization before charges are incurred.
Participation in the complimentary program does not guarantee indefinite access to every service or feature. Joy 4 Healthy Living™ and WatsonGuard™ may modify program features, eligibility requirements, or available services as the program develops, subject to applicable commitments and requirements.

7. PARTICIPANT STATUS, MONITORING PAUSES, REACTIVATION & TERMINATION
Participant status may change over time based upon participation, the availability of current information, program eligibility, and applicable program requirements.
A. Active Participant
A Participant may be considered active when they remain reasonably engaged with the program and provide sufficient current information to support the WatsonGuard™ services in which they are participating.
Active status does not require perfect or uninterrupted participation. Occasional missed submissions, temporary absences, illness, travel, hospitalization, caregiving responsibilities, technology difficulties, or other reasonable interruptions do not automatically constitute a violation of this Agreement.
B. Monitoring Paused / Inactive
When sufficient current information is unavailable, WatsonGuard™ may designate individualized monitoring as Monitoring Paused and/or designate the Participant as inactive for services that depend upon current participant information.
During a monitoring pause, WatsonGuard™ may be unable to provide reliable individualized trend analysis, personalized insights, reports, alerts, follow-up, or other data-dependent support.
A monitoring pause is not a punishment, financial penalty, or automatic termination from the entire Joy 4 Healthy Living™ community. Access to general community activities, educational resources, or other non-monitoring services may continue where appropriate and subject to applicable program guidelines.
C. Participant Outreach
When reasonably practical, the program may attempt to contact a Participant whose participation or information has become insufficient for continued individualized monitoring. Outreach may be used to determine whether assistance, clarification, temporary accommodation, or reactivation is appropriate.
The program is not obligated to indefinitely maintain active individualized monitoring when sufficient current information is unavailable.
D. Reactivation
An inactive Participant or Participant whose monitoring has been paused may request to resume active participation.
Reactivation may require updated health and wellness information, confirmation of current medications or relevant changes, updated acknowledgments or agreements when applicable, and sufficient information to establish an appropriate current monitoring baseline.
Once sufficient current information is available and applicable reactivation requirements have been satisfied, individualized WatsonGuard™ monitoring and support may resume.
E. Restriction or Termination for Cause
Joy 4 Healthy Living™ and/or WatsonGuard™ may restrict or terminate participation when warranted by circumstances including, but not limited to:
– intentionally providing materially false or misleading information;
– misuse, manipulation, abuse, or attempted unauthorized access to program systems or services;
– threatening, harassing, abusive, discriminatory, or seriously disruptive conduct toward participants, staff, volunteers, healthcare professionals, or community members;
– material violation of this Agreement or applicable program safety requirements;
– use of the program in a manner that creates an unreasonable safety, legal, privacy, security, or operational risk; or
– other serious circumstances making continued participation inappropriate or impracticable.
When reasonably appropriate, the Participant may be informed of the restriction or termination and any available steps for review or future re-entry.
F. No Automatic Paid Conversion
Inactive status, a monitoring pause, restriction, or termination does not automatically enroll the Participant in a paid service and does not create a financial obligation.
Any Enhanced or Premium service requires separate voluntary enrollment, disclosure of applicable fees, and affirmative authorization by the Participant.

8. ENHANCED & PREMIUM SERVICES
Joy 4 Healthy Living™ and/or WatsonGuard™ may offer optional Enhanced or Premium services to Participants who desire additional individualized support beyond the services included in the complimentary program.
Enhanced or Premium services may include, but are not limited to:
– More frequent individualized wellness support
– Expanded health trend analysis and reporting
– Individualized wellness planning and goal support
– Healthcare-visit preparation and organization of participant-provided information
– Post-visit review and educational support
– Additional one-on-one support
– Expanded monitoring or reporting features
– Other enhanced services made available by the programEnrollment in Enhanced or Premium services is entirely voluntary.
A Participant will not automatically be enrolled in a paid service because the Participant becomes inactive, WatsonGuard™ monitoring is paused, community participation changes, or complimentary services are reduced or discontinued.
Before enrolling in any paid service, the Participant will be provided information regarding the applicable service, benefits, limitations, fees, billing terms, and any additional terms or agreements that may apply.
No paid service will begin and no charge will be incurred without the Participant’s separate affirmative authorization.
A Participant’s decision not to purchase an Enhanced or Premium service will not, by itself, be treated as a violation of this Agreement.
Availability, features, and pricing of Enhanced or Premium services may change over time. Any applicable terms will be disclosed as part of the separate enrollment process.
Enhanced or Premium services provided through Joy 4 Healthy Living™ or WatsonGuard™ remain wellness education, monitoring, information-organization, and participant-support services within their defined scope. Payment for enhanced services does not convert WatsonGuard™ into a medical provider and does not replace care from physicians or other licensed healthcare professionals.

9. MEDICAL DISCLAIMER
Joy 4 Healthy Living™ and WatsonGuard™ provide wellness education, health-information organization, monitoring support, trend awareness, and tools designed to help Participants become better informed and better prepared between healthcare visits.
Joy 4 Healthy Living™ and WatsonGuard™ do not diagnose disease, prescribe medications or treatment, independently modify a Participant’s medical treatment plan, or replace physicians or other licensed healthcare professionals.
Information, trends, observations, educational materials, reports, alerts, recommendations, or other communications provided through the program are intended to support informed discussion and decision-making with appropriate healthcare professionals. They are not a substitute for professional medical evaluation, diagnosis, treatment, or emergency care.
Participants should not start, stop, change, or adjust prescription medications or physician-directed treatment solely on the basis of information provided through Joy 4 Healthy Living™ or WatsonGuard™. Questions concerning medications, treatment plans, diagnoses, symptoms, or medical conditions should be directed to the appropriate licensed healthcare professional.
WatsonGuard™ may identify patterns, changes, trends, or participant-reported information that warrant attention or further discussion. Such identification does not constitute a medical diagnosis or guarantee that a medical condition has been detected.
Emergency Situations
WatsonGuard™ and Joy 4 Healthy Living™ are not emergency-response or emergency-monitoring services. Participants should not use the program to request or wait for emergency assistance.
If a Participant believes they may be experiencing a medical emergency or serious or rapidly worsening symptoms, they should seek immediate medical assistance through appropriate emergency medical services.
The Participant remains responsible for obtaining appropriate medical care and for following the advice and treatment instructions of their licensed healthcare professionals.

10. LIMITATION OF LIABILITY
The Participant understands that Joy 4 Healthy Living™ and WatsonGuard™ provide wellness education, participant-support services, health-information organization, and monitoring tools within the scope described in this Agreement.
WatsonGuard™ relies substantially upon information provided by the Participant and, where applicable, information made available through participating devices, systems, records, or other authorized sources. The accuracy, completeness, and timeliness of WatsonGuard™ observations, trends, reports, and support may therefore be affected by missing, inaccurate, delayed, incomplete, or outdated information.
WatsonGuard™ does not guarantee that every health change, risk, abnormal reading, symptom, trend, or medical condition will be identified, detected, reported, or communicated.
Joy 4 Healthy Living™ and WatsonGuard™ are not responsible for medical decisions made independently by a Participant or for a Participant’s decision to delay, avoid, discontinue, or modify professional medical care contrary to the advice of an appropriate licensed healthcare professional.
The Participant remains responsible for seeking appropriate professional medical evaluation and emergency assistance when necessary.
To the fullest extent permitted by applicable law, Joy 4 Healthy Living™, WatsonGuard™, their owners, officers, employees, contractors, volunteers, affiliates, and authorized representatives will not be liable for indirect, incidental, special, consequential, or similar damages arising from participation in or use of the program, except where liability cannot lawfully be limited or excluded.
Nothing in this Agreement is intended to waive or limit any right, protection, duty, or liability that cannot legally be waived or limited under applicable law.

11. VOLUNTARY PARTICIPATION & WITHDRAWAL
Participation in Joy 4 Healthy Living™ Powered by WatsonGuard™ is voluntary.
A Participant may choose to discontinue individualized WatsonGuard™ monitoring or withdraw from the program at any time, subject to any reasonable procedures necessary to process the request and maintain appropriate program records.
A. Discontinuing Individualized Monitoring
A Participant may request that individualized WatsonGuard™ monitoring and personalized data-dependent support be discontinued. Once monitoring is discontinued, WatsonGuard™ will no longer be expected to provide ongoing individualized trend analysis, personalized monitoring, reports, alerts, or other services that depend upon continued participant information.
Discontinuing individualized monitoring does not necessarily require the Participant to leave every Joy 4 Healthy Living™ community activity or educational resource. Continued access to non-monitoring community programs may be permitted according to applicable program guidelines and eligibility requirements.
B. Withdrawal From the Program
A Participant may also choose to withdraw completely from Joy 4 Healthy Living™ and WatsonGuard™ participation. Complete withdrawal may result in termination of access to participant-only services, groups, monitoring features, communications, and other resources associated with active enrollment.
C. Previously Collected Information
Withdrawal or discontinuation of monitoring does not necessarily require deletion of information previously collected or created during participation. Certain information may need to be retained for legitimate program administration, recordkeeping, legal, security, contractual, research, system-development, intellectual-property, or other permitted purposes, subject to applicable law and the terms of this Agreement.
Where participant information is retained for secondary purposes such as system evaluation, development, statistical analysis, research, or intellectual-property support, applicable privacy and data-protection provisions of this Agreement continue to apply.
D. No Financial Penalty for Withdrawal
Withdrawal from complimentary participation or discontinuation of WatsonGuard™ monitoring does not automatically enroll the Participant in a paid service or create a new financial obligation.
Any separately purchased Enhanced or Premium service will be governed by its own applicable cancellation, billing, and service terms.
E. Return to the Program
A former or inactive Participant may request to return to the program. Re-entry may require updated enrollment information, updated agreements or acknowledgments, confirmation of current health and wellness information, and establishment of an appropriate current monitoring baseline before individualized WatsonGuard™ monitoring resumes.
